Please note that we do not accept registered or certified mail becuase our postman refuses to knock on our door. This mail will be rejected and returned to sender. We don't have time to drive to NW 25th street to claim it. Checks and money orders must be mailed with DHL, FED-EX UPS or any other private company.
All products are extensively tested prior to shipment, however if you do receive a product that develops a fault we will replace the item or arrange a refund where necessary. Contact us in advance of sending the product as we may need to supply you import paperwork if you are outside the USA. Failure to observe this procedure may result in your shipment being refused and returned to you at your expense.
Prices
Broadcast Concepts reserves the right to alter prices at any time without prior notice. All prices are in USD (US Dollars).
Delivery and Transit Delays
Wherever possible shipping/delivery is recorded or registered. The shipping/delivery time to most countries of the world is normally within 14 working days, however on some occasions this may be extended by a few days if the postal system or carrier has restrictions or additional delays beyond the control of Broadcast Concepts.
Broadcast Concepts will use reasonable endeavors to meet delivery estimates but cannot accept any liability whatsoever for failure to do so however arising. The dates quoted for shipping/delivery are estimates only and a failure by Broadcast Concepts to comply with them shall not be a breach of these terms and conditions of sale.
Extremely urgent orders are not welcome and may be refused. An extremely urgent order is one where the buyer will return the goods if they are delivered late from a courier delay. Example: We had a customer in Georgia who returned his low pass filter because FED-EX was 2 hours late.
The goods shall be at the Customer's risk on receipt of shipment/delivery, or, if the Customer has requested that he has arranged the collection of goods, at his risk on collection by him or his appointed agent.
The Customer is required to inspect the goods on receipt and to notify Broadcast Concepts of any defects or complaints within 30 days.
General Descriptive Matter
Whilst every Endeavor is made to ensure accuracy, illustrations or other details contained in the Broadcast Concepts website or brochure or any price list or advertising material or otherwise communicated to the Customer are intended merely to present a general idea of the product and nothing contained in any of them shall form part of the terms and conditions of sale between Broadcast Concepts and the Customer.
Limitation of Liability
The Customer will be responsible for ensuring the fitness for purpose of the goods for the Customer’s application. Broadcast Concepts accepts no liability whatsoever or howsoever arising in respect of loss, damage or expense arising from errors in information or advice provided whether or not due to the negligence of Broadcast Concepts or that of its employees, agents or sub-contractors save for any loss or damage arising from personal injury.
Broadcast Concepts shall not be liable to the Customer by reason of any representation (unless fraudulent) for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of Broadcast Concepts, its employees or agents or otherwise) which arise out of or in connection with the goods or their use or resale by the Customer.
Intellectual Property and Information
Broadcast Concepts are trademarks of Broadcast Concepts. Internet domain name Broadcast Concepts.com is licensed and owned by Broadcast Concepts. All materials on any web site server using an Broadcast Concepts controlled domain name, brochure, any price list or advertising material, including, but not limited to the images, logos, text, JavaScript, illustrations and designs may not be copied, reproduced, republished, uploaded, posted or distributed in any way, including by e-mail or other electronic means. Without the prior written consent of Broadcast Concepts, modification of the materials, use of the materials on any other web site or networked computer environment is a violation of the copyrights, trademarks and other proprietary rights and is prohibited.
Broadcast Concepts takes all reasonable steps in the course of business to ensure that any work commissioned does not infringe any patent, design, trademark, copyright or any other rights of third parties.
Force Majeure
Broadcast Concepts shall not be liable to the Customer or be deemed to be in breach of contract by reason of any delay in performing, or any failure to perform, any of the obligations in relation to the goods and services, if the delay or failure was due to any cause beyond the reasonable control of Broadcast Concepts. Without prejudice to the generality of the foregoing, the following shall be regarded, but not limited to, as causes beyond the reasonable control of Broadcast Concepts:
Law
Any sale transacted by the Broadcast Concepts, is governed solely by Florida Law any and all parties agree to submit to the exclusive jurisdiction of the State of Florida and its courts.
Partial Ineffectiveness
If any term or provision of this agreement or the application thereof to any circumstances to be invalid or unenforceable, the remainder of this agreement, or the application thereof to any circumstances other than those to which is invalid or unenforceable, shall not be effected thereby and each terms and provisions of this agreement shall be valid and enforced to the fullest extent permitted by law.

Warranty Returns Policy
In the event of goods being returned the customer:
Any goods returned that are not covered under the manufacturers warranty will be liable to inspection charges, parts, labors and delivery costs, these must be paid for in full before returning the goods to the customer. Goods repaired and not paid for in full within 90 days will be sold to cover any costs incurred by Broadcast Concepts.

All orders regardless of item must be paid in full prior to shipping this includes and encompasses all service, consulting, installation and custom orders. Upon receiving the Customer's order, the:
Warranty Returns Policy
The parts and any workmanship commissioned by Broadcast Concepts is guaranteed for a period of 12 months from the date of the sales invoice against manufacturing defects, providing the goods:
Qualifying goods will be repaired or, at our option, replaced providing the goods are returned to us, carriage paid and suitably packaged within a 12 month period, together with a copy of the original sales invoice. To prevent import charges being made on returned goods from countries and territories outside the USA, 4 photocopies of the original Broadcast Concepts sale invoice should be attached to the outside of the packaging, together with the relevant completed customs documentation stating that the goods originated from the USA and are being returned for repair/replacement. Under no circumstances will any returned goods requiring payment of import charges be accepted by Broadcast Concepts.

Refunds and Return/Replacement Policy
Please take care when ordering your goods. Items returned because they were incorrectly ordered may be subject to a 15% restocking fee.
If you need to return an item to us please first send an email to us with information about your product, your purchase (order number, invoice number) and your reason for wanting to return the product. We will reply with full instructions on how to return the goods. Returns / Repairs sent to Broadcast Concepts from outside the USA must have correct customs import paperwork to avoid Broadcast Concepts being charged duties. We will provide paperwork for you if you need to send something to Broadcast Concepts. Goods sent to Broadcast Concepts without the correct paperwork will be refused and returned to the sender at the senders expense.
Shipping & Handling costs are not refunded.
Please note that orders can not be canceled after they are shipped. Any chargeback is considered an order cancelation and we will pursue remedies with the chargeback issuer ie, credit card company or paypal to enforce our terms and conditions.
Meanwell Power Supplies:
We do not warrany Meanwell power supplies. If you recieve a power supply that is DOA or fails shortly after placed into service there is nothing we can do. Please concider this before making your purchase. Meanwell does offer a warranty. Please contact them for return authorization number and instructions. Our profit on power supplies barely covers our costs of supplying them; therefore, we simply can not afford to take power supplies back. Faulty Items

Technical support:
We do offer free technical support for most of the items that we sell; however, we reserve the right to refuse technical support at our option. Technical support may be refused when an unusual amount of support is requested for a simple product. All of the products that we sell require knowledge of electronics, RF and broadcasting along with soldering experience . If you have never used an FM pallet or you have never replaced a damaged transistor then you may be on your own after the purchase of these items. We are not selling “plug and play” appliances here. If you don't have the experience please don't expect unlimited technical support.
It shall be a violation of our terms of service to request technical support concerning the installation of power supplies. We can tell you which supply will work with a certain pallet but that's it. This is a liability issue. Incorrect installation of a power supply may result in serious injury and/or property damage. Please consult the manufacturers datasheets for information on power supplies.
We want all of our customers to be successful. Sometimes this means refusing business to protect the customer and ourselves.
Refusal of business:
We reserve the right to refuse business from any person for any reason.
Hostile Acts & business refusal
We will refuse business from any person who fails to provide identification on a credit card or paypal order. As part of our security procedures we may request photo ID along with the 3 digit code on the credit card. We will also refuse business from persons who issue credit card or paypal chargebacks and persons who demand that we use USPS for shipping.
Licensing
Some of our products, particularly transmitters, require an operating license. It is an offence in some other countries of the world to radiate electro magnetic waves at certain frequencies without a license. It is the Customer's responsibility to check relevant laws, regulations and directives regarding licensing and putting into service any goods commissioned by Broadcast Concepts. The Customer agrees to defend, indemnify and hold harmless Broadcast Concepts, it's employees and agents, from and against any claims, actions or demands, including without limitation legal and accounting fees, alleging or resulting from the improper or unlawful use of goods commissioned by Broadcast Concepts.
FED-EX Broker Fees
FedEx Broker Fees are the responsibility of the recipient. Failure to pay these fees may result in your name being added to customs black list. This could prevent you from receiving goods in the future from us or other merchants.
Shipping methods
We use FED-EX, DHL and UPS for shipping. We reserve the right to use any of these companies without notice on a website order. We will automatically refund the customer if there is a cost savings when we use a different courier than the one selected at checkout. We do not use the USPS (united states postal service). Any special shipping instructions must be sent by email, fax or telephone. If you have your own UPS or FEDEX account we will not be able to bill to it since these costs can easily be chargedback to us.
Customs tampering damage result:
In some countries incoming goods are opened inspected and repacked by customs agents. In many cases the goods are not repacked properly. We can not assume responsibility for package tampering. This is a big problem in most countries in south america. Please understand that if you are importing something from us you will be assuming some risk of damage.
Special Shipping instructions:
Any special shipping instructions must be sent by email, fax or telephone. The website order checkout page shall not be used for sending messages since this information may not be received. This is very important in the case of paypal website orders.
FED-EX Signature Release Waivers - Domestic Shipments:
If you are ordering a product from us or one of our distributors please make sure that you do not have a FED-EX signature release waiver on file with FED-EX. It is the customer’s responsibility to monitor package progress with the FED-EX tracking number and arrange for secure delivery. Any shipment that is claimed as lost with a release waiver shall be the customer’s loss and not ours.
Import Taxes VAT
Almost every country imposes an import tax or VAT. We do not collect VAT or import taxes. Usually shipments are not released unless all taxes are paid; however, in some situations FED-EX will invoice for taxes several weeks after the shipment is received. Please cooperate with your tax authority and pay this invoice. We will refuse to do business with any one who does not pay these import taxes. If you disagree with this policy then please take your business somewhere else.
The present terms and conditions of sale herein shall apply unless otherwise stated in a written agreement on Broadcast Concepts official headed documentation, to both export sales and sales made by Broadcast Concepts. These terms and conditions of sale override and exclude any other terms stipulated or incorporated or referred to by the Customer, whether in the Customer order or during any negotiations or any course of dealing established between Broadcast Concepts and the Customer, and constitute the entire understanding between Broadcast Concepts and the Customer for the sale of products or services.
Forfeiture: It is the buyers responsibility to monitor the progress of an international shipment using the tracking number (ie FEDEX) supplied by Broadcast Concepts Inc. The buyer is responsible to clearing the package from customs. Most countries will begin forfeiture proceedings when import taxes are not paid and/or licences and permits were not in place. We are not responsible for forfeiture actions by customs in foreign countries.
Product test data
All products are thoroughly tested prior to shipment; however, we do not provide test data or test reports. If we were to collect data on every product that we sell it would significantly increase product costs and lead-time with no benefit in quality. We have developed our own internal test procedures to guarantee that all products meet advertised specifications. If your application requires a test report please specify the data you want collected. Our engineering labor rate is $100.00 per hour with a 1 hour minimum lot charge.
